PERPETUA Warranty
Our products are created using carefully selected gemstones, as well as state of the art craftsmanship. However, we understand that issues may arise at some point, and that is why we stand behind our products and put your peace of mind in our heart with the following warranty:

Lifetime warranty on your Moissanite or Lab-Grown Diamond.

This includes: Optical properties of the stone, including brilliance, fire and color as well as physical integrity of the gemstone under normal use.
​
Two years' warranty from date of delivery against defects in materials and craftsmanship on all ring settings.
​
This includes manufacturing defects in PERPETUA settings, such as polish, finishing and gem mounting.
​
PERPETUA will assume the cost of repair and/or replacement of any part due to defects in material or production.
​
In those cases where a replacement of the piece is necessary, PERPETUA commits to replace it with a piece of equivalent or greater value than the original one.
​
PERPETUA commits to resolve any warranty claim within a period of no more than thirty (30) calendar days from the date of evaluation of the defect in question, unless otherwise notified to the customer.
​
PERPETUA reserves the right to evaluate any part that is subject to a warranty claim in order to assess its validity. This evaluation must be carried out within a maximum period of five (5) working days after receiving the piece under warranty.
​
The customer shall cover any shipping costs that may arise from a repair and/or replacement process under warranty.
​
All damage caused by misuse or neglect of the part is excluded from the effects of this warranty.
​
Any work carried out by third parties on a PERPETUA piece automatically invalidates the effects of this warranty.
Fine jewelry is delicate! Wear marks, scratches, dents, and other sorts of normal deterioration of the piece due to regular use are not covered by this warranty.

The warranty is not effective in the event of theft or loss of the piece.

Implied Warranty

In the event of defective supply, the customer may claim a warranty against PERPETUA Europa.
The customer is obliged to notify PERPETUA Europa of the defect as soon as it is discovered.
In the case of a purchase of a new product under a contract concluded with the purchaser, the right to claim for a supplementary warranty may not be exercised beyond the two-year limitation period from the date of performance of the contract.
The Purchaser may, at its option, request repair or replacement in the exercise of its warranty rights, unless it is impossible to do so or would involve PERPETUA Europa in additional costs that would be disproportionate to the costs of fulfilling any other warranty claim. The customer may switch from one warranty right to another, but must bear the cost of the switch, unless it was justified or PERPETUA Europa gave a reason for it.
Product Warranty
In case of a defect in the product, the customer may, at his/her choice, exercise his/her right to claim under the accessories warranty or the product warranty. A product is defective if it does not meet the quality requirements or if it does not have the characteristics described by the seller.
Perpetua offers a lifetime warranty on all gemstones offered by the Company. However, the purchaser has two years from the date on which the product was received to make a claim under the setting warranty. After this period, the right to claim under a setting warranty shall expire. When making a product warranty claim, the purchaser must prove that the product is defective.
A product warranty claim may only be brought against the seller or distributor of the movable item. The producer (distributor) is only relieved of his obligation to guarantee the product if he can prove that:
(a) the product was not manufactured or put into circulation in the course of his business, or
(b) the defect was not detectable according to the state of science and technology at the time when the product was placed on the market; or
(c) the defect in the product results from the application of a legal or regulatory requirement.
In the event of a product warranty claim, the Customer may only request the repair or replacement of the defective product. The same defect may not give entitlement to both an implied warranty claim and a product warranty claim. However, in the event of a successful product warranty claim, the seller may be held liable for the replaced product or the repaired part.
(d) If the claim refers to regular deterioration of the piece, such as scratching, denting, tarnishing, de-plating (in case of white gold pieces) and other affectations caused by wear.
Warranty (Guarantee)
According to the Hungarian Government Decree 151/2003 (IX. 22.) on the mandatory warranty for certain durable consumer goods, jewelry that is sold in Hungary under a consumer contract is:
1 year for a sales price of HUF 10,000 but not exceeding HUF 100,000,
two years for sales prices exceeding HUF 100,000 but not exceeding HUF 250,000,
Above a selling price of HUF 250,000, the product shall be covered by a 3-year guarantee.
The starting date of the warranty is the date of delivery of the product to the buyer. If the buyer starts using the product after 6 months from the date of delivery, the warranty period starts on the date of delivery of the product. PERPETUA Europa shall provide the product with an electronic warranty ticket, completed with the warranty start date, which it shall be required to deliver electronically no later than the day after the product is delivered.
The customer shall not be entitled to claim the right of guarantee if the cause of the defect occurred after the product was delivered to the customer (misuse, failure to observe the instructions for use, incorrect storage, incorrect handling, damage, loss, wear and tear, scratches, etc.).
In the event of a defect covered by the warranty, the claims which the customer may make are the same as those which may be made under the implied warranty.
PERPETUA Europa undertakes to carry out the repair or replacement within 15 days of the return of the product, but if the repair or replacement takes longer than 15 days, Perpetua Europa must inform the customer immediately of the expected time for repair or replacement. This information may be provided by electronic means, provided that the customer has given his prior permission.
If, during the warranty period, PERPETUA Europa determines that the product cannot be repaired during the first repair, PERPETUA Europa shall replace the product within 8 days, unless the customer has agreed otherwise. If the product cannot be replaced, PERPETUA Europa shall refund the purchase price to the customer within eight days.
If, during the guarantee period, the product fails three times after being repaired, unless the customer has agreed otherwise, and if the customer does not request a proportionate price reduction and does not wish to have the product repaired or replaced at PERPETUA Europa's expense, PERPETUA Europa must replace the product within eight days.
If the product has not been repaired within 30 days of the date on which PERPETUA Europa was notified of the request for repair, PERPETUA Europa shall replace the product within eight days of the expiry of the 30-day period, unless the consumer has specified otherwise. If it is not possible to replace the product, PERPETUA Europa is obliged to refund the purchase price to the purchaser within eight days of the expiry of the thirty-day deadline for repair.
The purchaser may, at his choice, submit his request for repair directly to PERPETUA Europa at its head office, at any of its branches or subsidiaries, or to the service indicated by PERPETUA Europa on the warranty ticket.
The warranty period does not include the time during which the customer cannot use the product as intended. In the event of replacement (repair) of the product or part of the product, the warranty period shall start again for the replaced (repaired) product (part of the product) and for the defect resulting from the repair. PERPETUA Europa shall be liable for the costs related to the fulfilment of the warranty obligation.
The same defect may not give rise to a claim for a warranty and a guarantee claim or a product warranty and a guarantee claim at the same time and in parallel.
